By using our application ("PocketChef"), you agree to comply with these Terms and all applicable laws and regulations. If you do not agree with these Terms, we ask that you do not proceed with the registration or use our application.
- Use of the Service
- The objective of our application is to provide an online platform to help food professionals manage their production costs.
- By using our service, you agree to provide true, accurate, updated and complete information during the registration process. You are responsible for maintaining the confidentiality of your access credentials and assume full responsibility for all activities that occur under your account.
- You agree not to use our application illegally, including, but not limited to, displaying names, texts, or product descriptions on the Digital Menu that violate the laws in force in Brazil, under penalty of having your account permanently blocked.
- You acknowledge that the use of our application is subject to the availability of internet services and the device in which the application is being used and we are not responsible for any interruptions, failures or delays that may occur due to technical or other problems.
- Service Subscription
- The application offers a free plan so the user can try the service on a limited basis.
- The features available in the free plan may be changed, including reduced, at any time at the discretion of Chef de Bolso Ltda.
- Subscribing to one of the paid plans offered by the application is the sole responsibility of the user. Subscribing to one of the paid plans offered by the application is done by selecting a plan, a monthly or annual billing method, and entering personal information including document (CPF or CNPJ for Brazilians), full address, and credit card information. All this data is required by the Finance Department of the municipality of Feira de Santana, BA, for the issuance of invoices.
- The subscription is charged on a recurring basis, monthly or annually, according to the user's choice when subscribing to the plan.
- The user can cancel the automatic renewal of the subscription at any time through the application by navigating to the "Subscription Plans" screen and clicking the "Cancel Automatic Renewal" button.
- The user is solely responsible for canceling the automatic renewal of their plan.
- After canceling the automatic renewal, the plan subscribed to by the user will no longer incur recurring charges and will remain active until its expiration date.
- According to the Brazilian Consumer Protection Code, the user may cancel the plan subscription within 7 (seven) days after the subscription is effective. To do so, simply contact Chef de Bolso Ltda. through the Support menu in the app or through the contact form available on the website https://pocket-chef.com.
- Intellectual Property
- All content present in our application, including texts, graphics, logos, icons, images, videos, audios, software and any other materials, is protected by copyright, trademarks and other proprietary laws intellectual.
- You agree not to copy, modify, distribute, transmit, display, reproduce, publish, license, create derivative works from, transfer or sell any information, software, products or services obtained through our application, without prior written authorization.
- Limitation of Liability
- Our application is provided "as is" without warranties of any kind, either express or implied.
- Under no circumstances will we be liable for any direct, indirect, incidental, special, consequential or punitive damages arising out of the use of or inability to use our application, including lost profits, business interruption, or loss of information, even if we have been advised of the possibility of such damage.
- Legal Use of the Service
- By using our application, you agree not to carry out activities that violate any law, regulation or third party rights.
- It is strictly prohibited to use the application for illegal activities, including, but not limited to:
- Infringement of copyrights, trademarks or other intellectual property rights.
- Distribution of content that is defamatory, obscene, xenophobic, misogynistic, racist, fraudulent or that violates the privacy of third parties.
- Activities that may harm the security or integrity of our application, or any network or system connected to it.
- We reserve the right to take appropriate action, including terminating your account and reporting to the appropriate authorities, if we suspect illegal use of the application.
- You are solely responsible for ensuring that your use of the application complies with all applicable laws.
- General Provisions
- We reserve the right to suspend, discontinue or modify the service at any time, for any reason, without notice.
- These Terms constitute the entire agreement between you and us relating to the use of our application, superseding any prior or contemporaneous agreements, oral or written, and superseding any additional or conflicting terms that may be present in previous communications between the parties.
- These Terms will be governed and construed in accordance with the laws of Brazil. Any dispute arising out of or related to these Terms will be subject to the exclusive jurisdiction of the Brazilian courts.
